Threats made by the BTMA board to homeowners


Threats of liens and foreclosure made by Burning Tree Master Association

Everyone is encouraged to hang on to all the letters and threats of liens received   from the BTMA (as evidence). Many have the letter to homeowners from Paula Hendrix, calling those who did not pay the BTMA their demand for money, "deadbeats".

WHAT ABOUT THE MOST RECENT THREAT?
Recently homeowners got an unsigned and undated letter on printer paper stating that "Because the Burning Tree Master Association by-laws obligate the board to file liens on
homes for unpaid assessments..."

 
The covenants of your subdivision, found within the Certificate of Dedication is the legal document that you go by. In other words: BTMA By-laws are trumped by the covenants of YOUR subdivision! It does not matter what the BTMA's say their by- laws state.  Is the BTMA aware of what it says in the  BTMA by-law Article XII 1 (b)?

ATTENTION BURNING TREE SOUTH AND  BURNING TREE ONE/TWO

Homeowners in Burning Tree South and  Burning Tree One/Two refer to your covenants under Membership. Your covenants read differently than   Burning Tree East Burning Tree Plaza and Burning Tree West covenants. (Compare them.)

  1. Libel is defined as defamation by written or printed words, pictures, or in any form other than by spoken words or gestures. Wouldn't calling people "deadbeats" be libel? What about handing out a list of people who have not paid...since they did not owe, if the person who handed out the list had checked the documents to ascertain beforehand.
